Arbitration in IT disputes
I think arbitration is the highest and most refined expression of dispute resolution. I suddenly realised it when I completed my postgraduate summer specialisation in international commercial arbitration at the Washington DC College of Law in 2010. What I have also realised over the years is that a capable and skilled arbitrator has to know the matter. And that is not only the law itself but the matter the issues arisen refer to. My first dominus, professor Matteo Ambrosoli, always repeated to me: “you must understand the fact before using law”.
That is why I have spent so many years on the entrepreneurs’ side, seeing first-hand all the little gears that make an industry move on. All those details that a lawyer doesn’t know.
In particular, I have spent the last ten years working both as CEO and in-house counsel for different companies operating in the IT industry. A precious and great opportunity to understand a blooming sector with so many technical issues to cope with!
